3 Strike Cases

The California Penal Code describes the nature of a strike offense. Strike offenses are violent or serious offenses. They can include offenses where the defendant/suspect was never in physical contact with an alleged victim. Residential burglary is one kind of offense that is considered a strike offense. A burglar does not have to have had any physical contact with anyone at the residence that he or she was robbing. You can be charged with a strike crime and not know it.

You should hire a criminal defense lawyer that is aware of which offenses are strike offenses, as well as the sentences that can accompany them. Our law firm may be able to reach a deal on your behalf where a strike offense is not included.

The laws related to strike offenses are varied and complex. They can be especially complicated if you are someone who already has at least one previous strike offense. If you have a prior strike offense and are convicted of any kind of felony, your sentence can double. Also, rather than serving no more than 50% of your sentence, you may have to serve up to 85% of your sentence if you are convicted for a strike offense. If you receive three strike offenses or more, you could end up serving anywhere from 25 years to a lifetime in prison.

If you are convicted of any felony after you already have two strike convictions, you could end up spending life in prison even if the third strike conviction was for a minor crime, such as a petty theft offense.
